BUYING PROCEDURE
Buying a property in Turkey can be quite a simple process, so long as you know what you are doing. By working with us we will endeavour to make the process as smooth as possible. We have outlined below a step by step guide of frequently asked questions to highlight what will be required. If you have any further questions do not hesitate to call and ask.

The first step
* Initially we will talk through your requirements – your budget, your accommodation needs, are you buying for pleasure, or investment, or both. Will you want to rent the property out, do you intend spending a large part of the year there, or just a few weeks in summer…


* Based on this knowledge we will gather a number of properties that we feel suit your requirements and arrange for you to view them. We want this part of the process to be enjoyable, informative and ultimately satisfying.


* This part of the process is similar to buying a property in the UK. However, when you find something you want to buy we will work with you in negotiating with the owner on your behalf, to ensure you get the best possible deal.
What happens once we have found your ideal holiday home and agreed a price?
Once the deal has been agreed we draw up a contract between yourselves and the seller, confirming the price, and agreeing on dates of transfer. We would require from you two passport sized photographs of the person whose name will be on the property deeds (the tapu), plus a photocopy of your passport. We will then go to the tapu office, located just off the main Ataturk Boulevard in Didim, where the official tapu application is made.
At this point your deposit is paid to the seller and the tapu is sent off to the City Council, who in turn send it to the Army Office in Izmir. The remaining balance of the purchase price is paid at a date negotiated between yourselves and the seller - usually when the tapu has been transferred.
What if the Army Office rejects our application?
This will only happen if you are declared bankrupt, have criminal convictions or are wanted by Iterpol/FBI. If this is the case we can advise you accordingly.
If by any chance you are rejected then any capital payments on the property are refunded less a £150 administration fee. Any money paid to cover legal and other administration fees are not recoverable and we cannot accept liability for them.
What other legal requirements are there?
All our transactions are carried out within the legal framework set out by the tapu office. Unlike the UK, legal representation is not a legal requirement when purchasing a property as contracts between the buyer and seller are legally binding documents in their own right. We have, on your behalf and in association with a solicitor, developed an easy to understand contract which ensures protection for both the buyer and seller throughout the process. If you would like to use a third party or a different solicitor for your own peace of mind, we are more than happy to arrange this for you.

 

What is the agency commission?

We charge NO commission on our own developments!!


The main costs are as follows:

* Agency commission – the standard rate charged is 6% split between the buyer and seller. As the buyer you will be liable for 3% of the purchase price.


* 3% purchase tax (stamp duty) shared between the buyer and seller.


* Land registration – approximately £120*.


* There may also be some small administration charges during the paperwork process.
